By working with, or using any services or content from Aeguana you are indicating full acceptance of the following terms and conditions:


Websites designed by Aeguana are done so at the exclusive direction of those clients contracting with Aeguana. Each project is undertaken as per the requirements of each individual client and uses such information provided by each individual client as is necessary. The sole and entire responsibility for the content or reliability of said information rests with each individual client.


All content including text, images and animations supplied by the client for use in web layout or graphic design projects must be thoroughly checked by the client for copyright infringement. The client is entirely responsible for all content provided.


INTERNATIONAL USE


You agree to comply with those regulations applicable to your Jurisdiction regarding the transmission of technical data exported from the United Kingdom or the country in which you reside. Aeguana exempts itself from liability for:


  1. Any errors or omissions in the client-provided content of any website which it has designed.

  2. Any damages to or viruses that may infect a visitor’s computer equipment, software, data or property that result from said visitor browsing websites designed by Aeguana.

  3. Any damages which result from the downloading of material, data, text, images, video or audio from any website designed by Aeguana.

  4. Any linked content to websites other than those designed by Aeguana that may be hyperlinked from Aeguana websites. This includes resulting damages from a site visitor’s access to any such non-Aeguana site.

  5. Damage of any kind (direct, indirect, consequential, incidental or punitive including without limitation loss of business, opportunity, data, profits) resulting from the use of, access to, or inability to use, such information contained in any web site which Aeguana has designed for its clients.

Each individual web site owner reserves the exclusive right to alter its site content in any way, at any time and for any reason without prior notification carrying no liability for any consequences of such changes.  If Aeguana receives work to serve site owner directives to change proprietary site content, such work is undertaken on the clear understanding that said changes are subject to the same terms and conditions as contained in this agreement.


Aeguana will not be responsible for damages arising from or relating to the provision or lack of provision of web hosting services. Unless a web hosting service is endorsed or provided by Aeguana, actions leading to cessations of hosting provision as in no way affiliated with Aeguana and thus, it exempts itself from liability, charge or responsibility in the event of such cessations. 


Aeguana will concurrently hold no responsibility for fraudulent transactions processed via its website where such transactions are carried out using third party services under the terms and conditions of those non-affiliated services which were used or involved in the processing of said transaction. 


Aeguana makes no warranties of any kind, expressed or implied for the services it provides.

 

Aeguana reserves the right to revise its terms, conditions and charges at any time and without prior notice.

 

Aeguana shall not be liable for any incidental, consequential, special, or punitive damages resulting from lost or imputed profits or royalties arising out of this agreement or any goods or services provided irrespective of said liability arising in contract or in tort (including negligence and strict product liability).

The provisions set forth above allocate the risks under this agreement between the parties and it is agreed that such allocations and limitations are enforceable at law.


ACCEPTABLE USE


Aeguana will not be liable in any way for any content, loss, or damage of any kind resulting from the use of any content transmitted via its services. You, the client, agree to bear all risks associated with the use of any content, including any reliance on the accuracy or completeness of such content.


These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.
